SMS Program Terms

These terms govern the HeavyOps Operational Alerts text messaging program.

These SMS Program Terms govern the HeavyOps Operational Alerts text messaging program operated by Neo Blue Technologies Inc, doing business as HeavyOps AI (“HeavyOps,” “we,” “us,” or “our”).

Program description

HeavyOps Operational Alerts provide non-marketing notifications about monitored industrial operations. Messages may notify eligible users when a monitored site enters an operational excursion and when that excursion is resolved.

Enrollment and consent

You may enroll through your HeavyOps account settings by providing your mobile telephone number, agreeing to receive text messages, and completing telephone-number verification.

By enrolling, you consent to receive recurring automated operational alert text messages from HeavyOps at the mobile number you provide. Consent is not a condition of purchasing any product or service.

Your organization may determine whether you are eligible to receive operational alerts. Your organization cannot, however, provide SMS consent on your behalf. You must enroll in SMS notifications yourself.

Message frequency and charges

Message frequency varies based on monitored-site events and your organization's alert configuration. Message and data rates may apply. Contact your wireless carrier for information about your messaging plan.

Opting out

Reply STOP to any HeavyOps text message to unsubscribe. You may also disable text alerts through your HeavyOps account settings. After opting out, you may receive one final message confirming your request. You will not receive additional HeavyOps Operational Alerts by SMS unless you enroll again. Disabling SMS does not necessarily disable email or in-application notifications.

Delivery and availability

Wireless carriers and messaging providers do not guarantee message delivery. HeavyOps is not responsible for delayed or undelivered messages caused by circumstances outside our reasonable control. Carriers are not liable for delayed or undelivered messages.

SMS notifications should not be used as the sole means of receiving emergency or safety-critical information.

Your responsibilities

You represent that you are authorized to use the mobile number you provide. If your mobile number changes or is reassigned, you must update or remove it from your HeavyOps account.

Privacy

We process your mobile number and SMS enrollment information as described in the HeavyOps Privacy Notice.

Changes or termination

We may modify or discontinue the SMS program. If we make material changes to these terms, we will provide notice as required by applicable law.

Other agreements

These terms apply only to the HeavyOps SMS program. Your organization's use of the HeavyOps platform remains governed by its applicable customer agreement with HeavyOps.
